Sets the rules for using the public website and accessing MK Assist information.
1. Acceptance and scope
By using the public MK Assist website, you accept these Website Terms of Use. These terms do not by themselves create a paid subscription. A subscription is governed by the Master SaaS Agreement, Order Form and incorporated schedules. If you do not agree, stop using the website.
MK Assist is a product of Stonda (Pty) Ltd., registration number 2020/843851/07, which is the legal contracting entity. Its registered address is 116 Summerset Road, Noordwyk, Johannesburg, Gauteng, 1685. Its operating address is 99 Stoneridge Drive, Greenstone Hill, Lethabong, 1609. Its VAT number is 4480296898. Formal notices, support, billing, privacy requests and complaints must be sent by email to hello@mkassist.co.za, with legal and Information Officer escalations to tondani@mkassist.co.za. Support hours are Monday to Friday, 08:00 to 17:00 South African time, excluding public holidays.
2. Business-purpose website
MK Assist is for legitimate business and organisational use. Information on the website is general product information, not legal, financial, medical or other regulated professional advice. No statement is a guarantee of uninterrupted service, perfect accuracy, complete security or a particular commercial outcome.
3. Permitted use
You may view, download and print public material for internal evaluation and lawful business use. You may not scrape the website at scale, probe or bypass security, introduce malicious code, impersonate another person, misrepresent authority, infringe intellectual property, interfere with availability, use the website to commit fraud or attempt to gain access to another client's workspace.
4. Intellectual property
The website, platform, designs, software, text, graphics, trademarks, processes and documentation are owned by or licensed to MK Assist and are protected by law. No right is granted except the limited right to use public material as stated here. "WhatsApp", "Meta" and third-party marks belong to their respective owners. MK Assist is not endorsed by those owners merely because it integrates with their services.
5. User submissions
When you send an enquiry, feedback or requested material, you confirm that you have authority to do so and that the material is lawful. You retain ownership of your material. You grant MK Assist a limited right to use it to respond, evaluate a potential service, protect the website and comply with law. Feedback about the product may be used to improve MK Assist, but confidential client data is not converted into shared training data.
6. Links and third-party services
The website may link to third-party services. Their terms and privacy notices apply. MK Assist does not control their content or availability and is not responsible for a third party merely because a link is provided.
7. Availability and changes
The website may be changed, suspended or withdrawn. Reasonable steps are taken to keep public pricing and descriptions accurate, but an obvious error does not create a right to a mistaken price or feature. Before payment, the client will receive the applicable plan, price and terms in the signup or Order Form flow.
8. Consumer-law savings
Nothing in these terms excludes a right or remedy that cannot lawfully be excluded under the Consumer Protection Act, ECTA or other applicable law. To the maximum extent permitted, MK Assist is not liable for indirect or consequential loss arising only from use of the public website. Liability under a paid service is governed by the Master SaaS Agreement.
10. Governing law and disputes
South African law governs these terms. The parties should first try in good faith to resolve a complaint through the Contact, Complaints and Escalation process. A competent South African court retains jurisdiction, subject to any mandatory consumer forum or remedy.
